Appeal case

An appeal case arises when a negative decision from the Immigration Service, SIRI, or another immigration authority is appealed to the Immigration Appeals Board (or Refugee Appeals Board in asylum cases). The appeal must be filed within the deadline — typically 8 weeks.

Appeal process

1. Appeal is filed in writing.
2. The lower instance reconsiders the case.
3. If rejection is upheld, the case is sent to the Immigration Appeals Board.
4. The Board issues a new decision.
