Suspensive effect means that the legal effects are temporarily postponed, and that possible consequences of a ruling therefor does not come into effect, before a ruling is made in your case.

Suspensive effect is the juridical description of your legal position when you for example apply for extension of your residence permit in time.

Legal residence when applying for extension

If you have submitted an application for extension of a residence permit before your permit expires, you have legal residence while we process your application for extension. This means that you can continue your stay with the same rights as when your initial permit was valid. For example, you are allowed to continue to work if you have applied for an extension of a residence permit or a residence and work permit – and you are entitled to full medical care as well.

If you leave Denmark

If you leave Denmark while you application for extension is processed and you do not hold a valid residence card, generally you cannot enter Denmark again.

If you need to leave Denmark and enter again before a ruling is made in your case, you can apply for a re-entry permit.
